A federal judge has ordered the prompt release of Kilmar Abrego Garcia from detention by ICE, concluding his ongoing confinement is without lawful basis.

"Since Abrego Garcia's return from wrongful detention in El Salvador, he has been taken back into custody, again without legal justification," Judge Paula Xinis stated in her order.

The situation originates in a erroneous removal to El Salvador earlier this year, which US authorities later admitted was an error. Following his repatriation to the United States to answer alien smuggling charges, he was held in immigration custody.

In her order, the judge noted that the authorities lacks a current deportation order, which prevents them from removing Mr. Abrego Garcia "for now."

The legal challenge center on conflicting assertions. While the Trump administration argues that Abrego Garcia is a affiliate of the MS-13 criminal organization, he vehemently disputes this claim.

He has also pleaded not guilty to the conspiracy charges, which are part of a separate trial in the state of Tennessee.
